These Terms of Service ("Terms") govern your use of www.xoneofart.com (the "Site") and any purchase you make from XONEOFART. By using the Site or placing an order, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and capable of entering into a binding contract to use the Site or place an order.

2. Products & Artwork

XONEOFART sells hand-painted artwork, including pieces created with AI-assisted design concepts executed by hand. Because each piece is painted individually, minor variations in color, brushwork, and texture from the photos shown are natural and expected. Our designer collections represent studio design identities; artwork is described accurately as hand-painted, and inspiration references to historical art styles are stylistic references only — we do not sell original works by, or reproductions attributed to, historical artists.

3. Orders & Payment

  • All prices are listed in U.S. dollars. Applicable sales tax is calculated at checkout.
  • We accept the payment methods shown at checkout, processed by secure third-party payment providers.
  • We reserve the right to refuse or cancel any order — for example, in cases of suspected fraud, pricing errors, or product unavailability. If we cancel your order, you will receive a full refund.
  • Placing an order constitutes an offer to purchase; the contract is formed when we send your order confirmation.

4. Preview Before Shipping

For hand-painted and custom pieces, we email you photos of the finished artwork before it ships. If we don't hear back within 3 days of sending your preview, the artwork will be shipped as shown. Adjustment requests at the preview stage are handled as described on our How It Works page.

5. Shipping & Returns

Shipping timelines, coverage, and our 30-day return terms are set out in our Shipping Policy and Return & Refund Policy, which form part of these Terms.

6. Custom Art

Custom commissions are made to order. Cancellation terms and the non-returnable nature of delivered custom pieces are described in our Return & Refund Policy. By submitting a custom brief, you confirm that any reference material you provide does not infringe third-party rights.

7. Intellectual Property

All content on the Site — artwork images, designs, text, logos, and photographs — is the property of XONEOFART or its licensors and is protected by copyright and trademark law. Purchasing a physical artwork transfers ownership of the physical piece only; reproduction rights remain with XONEOFART. You may not copy, reproduce, or use Site content for commercial purposes without our written permission.

8. User Content

If you submit reviews, photos, or videos of your artwork (for example, for our Real Homes gallery), you grant XONEOFART a non-exclusive, royalty-free license to use that content on our Site and marketing channels. You may ask us to remove your content at any time by emailing support@xoneofart.com.

9. Prohibited Use

You agree not to use the Site for any unlawful purpose, to infringe intellectual property rights, to transmit malicious code, or to interfere with the Site's operation.

10. Disclaimer & Limitation of Liability

The Site and products are provided "as is" to the fullest extent permitted by law. XONEOFART's total liability for any claim arising from a purchase is limited to the amount you paid for the product in question. Nothing in these Terms limits rights you have under applicable consumer protection law.

11. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in San Bernardino County, California, unless applicable law provides otherwise.

12. Changes to These Terms

We may update these Terms from time to time. The version posted on the Site at the time of your order applies to that order.
